It has faced a strong competition from both Government sector and local private and foreign banks. To face these challenges Crop Bank always has to introduce new technology, new financial products and new reward system to their employees and to their customers.The reward system is mainly concern thing within the Corp. Bank. Reward system for the Manager mainly based on the Customer satisfaction and leadership qualities. For the staff the reward system is based on customer satisfaction. These categories evaluated within three criteria. Within the Board meeting Bank CEO accept this rewarding system. Within this case study we have to find; 1. Outlining of Merits and Limitation of Crop Banks propose rewarding system for the manager and staff 2. Job Evaluation Methods: The essence of compensation administration is Job evaluation and the establishment of the pay structure. By Job evaluation we mean using the information in Job analysis to systematically determine the value of each Job in relation to all Jobs with in the organization. In short, Job evaluation seeks to rank all the Jobs in the organization and place them in a hierarchy that will reflect the relative worth of each. We must first understand what are the Merits and Limitations within the Crop Banks' current Nanking method.Merits 1 . It is a simple method; current ranking method is a simple one. It only based on â€Å"How much was the customer is satis fied†. So as we can see it is the easiest way of ranking. And the ranking method limits to only three categories they are â€Å"1 . Not meeting customer expectation, 2. Meeting Customer expectation, 3. Far Exceeding Customer expectation†. This is a simplest method on ranking. 2. This current ranking method is a low cost method; as we can see this is a simple ranking system, because of that this cost a low budget. 3. The current rating system can be used in service based organization.In the banking sector such as Corp. Bank they provide a service as for this current ranking method is based on customer service it can be a lot of help to a serviced based organization such as Banks. 4. Ranking method that is currently using by Corp. Bank can be use daily basis because it mainly concern about the Customer satisfaction. Limitations As we can see the Merits within the current reward system there are also Limitation within this. 1. Can't clearly measure the categories; the rewa rding system clearly based on the Customer Satisfaction. And it is only rated by â€Å"1 . Not meeting customer expectation, 2. Meeting Customer expectation, 3.Far Exceeding Customer expectation†. There is no guideline how to evaluate. This is a limitation occurred in current reward system in Corp. Bank. 2. As the above mention rewarding system is clearly based on customer satisfaction. From this we are facing a problem â€Å"Only Customer Satisfaction is enough? † As a developing Bank it is a limitation that Corp. Bank is only concern about the Customer satisfaction when there are more facts that should taken for ranking 3. When concentrating about the Customer Satisfaction factor we are clearly facing a halogen, how can we identify the customer satisfaction because Human is dynamic creature.Some Customers can be satisfied and some customers can never be satisfied because there needs and wants are clearly different. As Abraham Moscow has described there are different needs and want and there are different motivators. As we can see Human can not be easily satisfied. 4. Managers can not always control their subordinates. This is another limitation in the current ranking method in Crop Bank. Managers will not be able to control their subordinates; subordinates will always use their personal feelings within the aerospace. Managers can't always control this.Reward system only concerns about the customer satisfaction this because of the subordinates work Managers may have to pay the price. 5. The current reward system of the Crop Bank will not effect to the entire bank. Customer satisfaction will be only effect to the front office where the customers usually go. But when it comes to the back office customer satisfaction is not enough. For an example Accountants Job can't be evaluated from Customer satisfaction. So as we can see current rewarding system is not enough to evaluate the entire banking industries. 6.In the case study it is clearly mention f rom this reward system only the salary of the employees will go up. But not all people will get motivate from financial benefits. According to Herbage's theory everyone is not motivated by Money. 2. Develop an alternative reward system for bank employees and explain why it is superior to the proposed reward system There are four main Job Ranking Methods. We must first identify what is the most suitable ranking method for the Crop Bank. A. Ranking method: Raters examine the description of each Job being evaluated and arrange the Jobs in order according to their value to the company.This method requires a committee, typically composed of both management and employee representative to arrange Job in a simple rank order from highest to lowest. No attempts are made to break down the Jobs by specific weighted criteria. The committee members merely compare two jobs and Judge which one is more important, or more difficult to perform. Then they compare the other Job with the first two, and s o on until all the Jobs have been evaluated and ranked. The most obvious limitation to the ranking method is its sheer inability to be managed when there are a large number of Jobs.Other drawbacks to be considered are the subjectivity of the method- there are no definite or consistent standards by which to Justify the rankings- and the fact that because Jobs are only ranked in terms of order, we have no knowledge of the distance between the ranks. B. Classification method: A Job evaluation method by which a number of classes or grades are defined to describe a group of Jobs is known as Classification method. The classifications are created by identifying some common denominator skills, knowledge, responsibilities tit the desired goal being the criterion of a number of distinct classes or grades of jobs.Once the classifications are established, they are ranked in an overall order of importance according to the criteria chosen, and each Job is placed in its appropriate classification. This later action is generally done by comparing each position's Job description against the classification description and benchmark Jobs. The classification method shares most of the disadvantages of the ranking approach, plus the difficulty of writing classification descriptions, Judging which Jobs go where, and leaning with Jobs that appear to fall into more than one classification. . Factor comparison method: Raters need not keep the entire Job in mind as they evaluate; instead, they make decisions on separate aspects, or factors, of the Job. A basic underlying assumption is that there are five universal Job factors: (1) Mental Requirements, (2) Skills, (3) Physical Requirements, (4) Responsibilities, and (5) Working Conditions. The committee first rank each of the selected benchmark Jobs on the relative degree of difficulty for each of the five factors.Then, the committee allocates the total pay rates or each Job to each factor based on the importance of the respective factor to the job. A Job comparison scale, reflecting rankings and money allocations, is developed next. The raters compare each Job, factor by factor, with those appearing on the Job comparison scale. Then, they place the Jobs on the chart in an appropriate position. D. Point method: Raters assign numerical values to specific Job components, and the sum of these values provides a quantitative assessment of a Job's relative worth.The point method requires selection of Job factors according to the nature of the specific group of Jobs Ewing evaluated. After determining the group of Jobs to be studied, analysts conduct job analysis and write Job descriptions. Next, the analysts select and define the factors to be used in measuring Job value and which become the standards used for the evaluation of Jobs. Education, experience, Job knowledge, mental effort, physical effort, responsibility, and working conditions are examples of factors typically used.The committee establishes factor weights ac cording to their relative importance in the Jobs being evaluated, and then determines the total number of points to be used in the plan. A distribution of the point values to Job factor degrees is made, with the next step being the preparation of a Job evaluation manual. Point Rating method will be the most effective way for the Corp. Bank. It can be identify step by step. Determine the cluster of Jobs to be evaluated First we have to identify what are the Job categories in the bank.We can identify there are two categories in the bank as Front Office and the Back Office. Corp. Bank Front Office -Manager (Chief Manager) -Personal Banking Officer -Customer Service Manager -Executive Officer -Tellers Collect the Job Information Back Office -Operation Managers -Banking Assistant -Clerk Identify a clear knowledge about Job. We can prepare Job Analysis to identify about the Job. Now we can briefly identify Duties and Responsibilities about above mention job categories. Front Office:- Cust omer Handling. Opening Accounts, Updating and Issuing Pass books. Collecting cheeses and Drafts.Cash and Queue withdrawal. NRC Accounts handling Back Office:- Issuing Loans Issuing Credit Cards Loan Recoveries Other clerical works As we can see these two Job categories plays different roles within the same bank. Be equity towards both parties we have to identify Compensable factors that can evaluate both parties equally and fairly. Selecting Main Compensable factors and Sub Compensable factors To identify the value of the Job, we must select some main compensable factors that are common for every Job within the Crop Bank such as Skills, Effort, and Responsibilities.After identifying these main factors, we must identifying sub compensable factors that elaborate use of the main factors. Literature Review An employee is a particular individual that was hired by an employer to perform a certain task or a job. It’s the duty and the responsibility of the employee to perform the tasks that are being directed towards him/her by the employer and the employer must ensure that in return the employee is properly appraised for performing the task well. Employee appraisal is a vital part of the relationship between the employee and the employer. Employee appraisal is a source of motivation provided by the employer towards the employee to show whatever that he/she is doing or have already done is being appreciated by the company and that they wants the employee to keep up his/hers good performance. A well satisfied employee is always looking forward to perform much better day in day out and is willing work for the employer as long as he/she can. A demotivated employee’s enthusiasm is much lesser than a motivated employee’s enthusiasm. Enthusiastic behavior at workplace not le ads up to great individual performance; it also enlightens the other individual that surrounds the particular enthusiastic employee. A less friendly workplace can be bad for such individual’s, maybe even the management’s harsh work ethic’s or the work load that is being diverted towards the employee’s from the top management can ruin the enthusiastic atmosphere of a work place. These sorts of phenomena’s can lead up to employee turnover. There are two known types of employee turnover scenarios that can occur within an organization. Involuntary turnover is the turnover that occurs for employee termination, absenteeism or due to violations of the workplace policies. Voluntary turn occurs when and employee leaves a particular organization on his/hers own accord. In such incidents the employee can have number of reasons for leaving the particular organization. Employee turnover is derived to be bad for the performance of an organization. Researches have been conducted throughout the years to sort out the effects of employee turnover by many researchers worldwide. Such as, A Meta-Analysis of Antecedents and Correlates of Employee Turnover by Rodger .W Griffeth, Peter W. Hom and Stefan Gaertner (Year of 2000) The researchers started off with searching all published articles related to predictor turnover-relationships in the year of 1990’s with the use of computerized sources. They also researched organizational sciences with the use of various books written under the particular subject. And decided to add the  public correlations that were found out as solutions if they were to meet the criteria that is given below, 01. Actual turnover (except for the job leavers) was assessed 02. The study used a predictive design that collects predictor measures before Turnover occurrence. 03. Turnover was measured at the individual level of analysis Through their research they were able to find out that the reasons behind the employee turnover was mostly, job satisfaction, organizational commitment, job search, comparison of alternatives, withdrawal cognitions, and quit intentions. â€Å"Employee Turnover-a Study of its Causes and Effects to Different Industries in Bangladesh – Rezaul Hasan Shumon† In this particular research the researcher have considered analyzing some major factors that he thinks that plays a major role in causing employee turnover. The economy, characteristics of the job, demographics, the person, a bad match between the employee’s skills, lack of opportunity for advancement or growth, feelings of not being appreciated, inadequate or lackluster supervision and training and unequal or substandard wage structures. Through this research the researcher was able to find many causes for employee turnover, they are, irregular payment, less salary, improper management, job location, better job option and insufficient medical allowance is the causes that were found out to be the major reasons for employee turnover. And the researcher suggested some solutions that were voted the most by the employees as solutions that they prefer the most. Such as, Standard salary structure, standard increment and medical facilities were amongst the top three voted solutions b y the employees. Harris at al. (2002) According to Harris’s research, he came up with a theory stating that higher employee turnover rate of a firm, lower the rate of the firm’s ability to provide incentives to its employees, and ultimately it affects the firm by reducing its productivity. He also found out that the theory of job matching  postulates that turnover is a solution for both the employees and the employers can adapt to in order to avoid being restricted in sub-optimal matches. He also states that the issue of trying maintain the workforce stability and flexibility on an even scale is way too much of pressure to handle that it will easily point out the rise of an optimal turnover rate.

40 Connection between Writing and Sleeping Various people were told it is best to express your feelings and thoughts on paper. Bottling up your emotions and keeping them inside, could cause major stress on your body. That’s where the subject of diaries and journals come in to position. They are made to help others who can’t express their feelings verbally, express their feelings by writing them down. Writing however, does have a significant connection to sleep. Writing can affect how we sleep in multiple ways. â€Å"Forty percent of American adults say they have difficulty falling asleep at least a few times each month. The most common reason is an inability to stop thinking aboutwhatever it is you can’t stop thinking about.† (Denworth, 2018). Almost everyone has had trouble falling asleep either because they were worried about something or someone, or they constantly can’t stop thinking about a situation. Studies shows that if we write down our thoughts before we go to bed, then you’ll be able to fall asleep faster at night. â€Å"There’s something about the act of writing, physically writing something on paper, that tends to offload it a little bit, or help us hit the pause button on it. The outcome seems to be [that] you decrease cognitive arousal, and you decrease rumination and worry† (Denworth, 2018). Cognitive arousal comes from a theory that was created by Stanley Schachter and Jerome E. Singer. This theory is known to the cause of misinterpret thoughts because it is based off two factors: cognitive label and physiological arousal. To sum this up, writing your feelings down before bed, will help you fall asleep faster but it will also decrease the chance of misinterpreting your thoughts. Not only does writing before bed helps you fall asleep quicker but writing a to-do list versus a completed list, will also affect how you sleep. â€Å"If you test people’s memory for things that were unfinished versus things that were completed, people remember the things that were unfinished a lot better. It seems that unfinished tasks rest at what we call a heightened level of cognitive activation† (Denworth, 2018). Cognitive activation is the idea of stress. It is about learning new ways to solve problems and focusing on the steps that was taken to solve the problem. Not so much of focusing on the answer itself but the action. When something is not done, our mind tends to drift off towards that because we consistently think about ways we can complete that project. We think of events that will happen the next day that will affect how the project gets done. From personal experience, I can recall a time where I had a major mid term project due. Of course, I was a procrastinator, so I waited till the day before it was due to fully complete it. It was late in the night and I told myself that I was going to finish it in the morning. Moral of the story, I was up all night and I didn’t get any sleep because I was thinking about this unfinished project that I still had to complete. The next day I was drowsy, and I didn’t feel very well. I did finish my project but because of my lack of sleep, my presentation did not reflect my best work. Thinking back, some ways I could’ve took to avoid this situation would include; not waiting until the last minute to finish or taking a few minutes before bed to write down exactly what I needed to do in order to complete it. Based on the reason of not having that completed or written down, I lost a very much effective sleep and major points on an important assignment. Don’t be like me. Write your thoughts down. Researchers and readers still have unanswered questions pertaining to writing and the affects of sleep. The two main questions Denworth is being asked are, did to-do lists improve sleep in other ways? If so, do you think the effect can be sustained? Her response was â€Å"We haven’t tested that. It could be, yes, because each night you’ve got this big to-do list. But [it’s also true that] the to-do list fluctuates, and how much you accomplish during the day also feeds into that. So maybe it’s going to be most effective on the nights when you have a whole lot of stuff to do, and it’s more likely to be eating at you if you don’t write things down† (Denworth, 2018). During this study, I believed she used an experiment for only one night. The goal of this study is more so understanding because we are having the ability to understand the connection between writing and sleep. You write down your day’s thoughts, you get a longer sleep. Structuralism is an idea founded by Wilhelm Wundt and his ideas was focused more on the structure of mental life into the building blocks of life (personal experiences). This study corresponds more with structuralism because the connection between writing and sleep is reflecting off your pass experiences and analyzing them into your mental life, to determine the amount of sleep your will get. In this experiment, the dependent variable is the amount of time it takes for that individual to fall asleep. The independent variable is taking five minutes before bed to write down your thoughts, feelings, or your to-do list. In conclusion, taking a little time before bed to reflect on your day is very effective. It will determine how your body act towards sleep. Remember our body need as much energy as it can get, so we should treat it with care. Even the littlest thing, can affect how much sleep we can receive. Our brains are always working, so it is highly recommended that we clear our mind while we are sleeping to get that full stock of energy for the next day. One way to achieve that is to write.

There has been some progress in the implementation of reforms in Eastern Europe, but the supply response thus far has been limited. Signs of a bottoming out of the contraction can be discerned in some countries, but further output losses may yet be in store. In the republics of the former U.S.S.R., the reform process has barely started.† 2 The transformation from communism to democracy involves radical overhaul of former authoritarian institutions. Hence, political commentators were under no illusion about the turbulences it is going to involve. Already, in the twenty years since the collapse of the Soviet Union, three former communist countries of the union have seen political upheavals. The Rose Revolution threw out Eduard Shevardnadze in Georgia and brought to power a 36-year-old lawyer from New York. The Orange Revolution that followed in 2004 handed power to Viktor Yushchenko, who is known to have the backing of Washington. Yushchenko's election victory was disputed by the opposition party and he narrowly escaped an assassination bid as well. Grocery has written contracts with many different vendors to purchase the products they sell in their stores. Vendors range from individuals to international corporations. Tom works as the produce manager for the store in My Town, U.S.A. Jeff, 17 years old, is spending his summer vacation working for Tom in the produce department. A.) Does Article 2 of the Uniform Commercial Code (UCC) apply to the contracts between Grocery and its vendors? Do common law contracts apply? Explain, in detail, why or why not. Your answer should compare and contrast common law contracts and UCC Article 2 contracts. Yes Article 2 of the UCC does apply to the contracts between Grocery and their vendors. Article 2 applies to all contracts for the sale of goods (2-102). The code contains a somewhat complicated definition of goods (2-105); the most important thing to understand is that the term goods means tangible personal property. Article 2 does not apply to contracts for the sale of real estate or stocks and bonds and other intangibles. The drafters of the code also tried to promote fair dealing and higher standards of behavior in the marketplace. They attempted to do this in several ways in Article 2. The Code imposes a duty on everyone making agreements under the Code to act in good faith (1-203). The Code also imposes certain standards of quality on sellers of goods as a matter of law. Common law contracts would also apply to the Grocery and their vendors, due to the mixture of goods and services. Common law would apply to the service element that is predominant in the contract with regards to the delivery of the goods. (Barnes, J). The difference between Article 2 and common law is that if the contract is for the sale of goods then Article 2 would apply, if it is not then the principles of common law under contracts would apply. Article 2 reflects an attitude about contracts that is fundamentally  different from that of the common law. The Code is more concerned with rewarding peoples legitimate expectations than with technical rules, so it is generally more flexible than traditional contract law. A court that applies the Code is more likely to find the parties had a contract than a court that applies contract law (2-204). In some cases, the Code gives less weight to technical requirements such as consideration than is the case in contract law. (Barnes, J). B.) Grocery contracted with Masterpiece Construction to renovate the store on Main Street in My Town. Masterpiece, unable to complete the renovation within the six month time limit due to a sudden increase in jobs, sub-contracted the entire job to build them to fall. Grocery was unaware of the sub-contract. When Grocery realized (due to poor quality of work) that Build, not Masterpiece, was handling the renovation, Grocery petitioned the court for an injunction and then sued Masterpiece for breech of contract and specific performance. Masterpiece argued that it had a right to delegate the duties of the contract, or in the alternative, to discharge the contract due to commercial impracticability. Who wins? Explain your answer. Based on the information provided by Grocery would win the case based on breech of contract and specific performance. Under breech of contract, promissory must perform their contractual duties in the manner they have promised to perform them. Since Masterpiece did not perform the duties in the manner in which they promised they are liable for breech of contract. The courts recognize that there are three basic degrees of performance: complete or satisfactory performance, substantial performance, and material breech of contract. (Barnes, J). A contract consists of both rights and duties. A contracting party has the duty to perform his or her own promise and the right to receive the other partys promised performance. These rights and duties can usually be transferred to third persons. When rights under a contract are transferred, this is called assignment. The transfer of duties is called a delegation. Not all contracts are assignable  over the objection of the promissory. The promissory who delegates duties is still liable to the promise if the party to whom the duties were delegated fails to satisfactorily perform them. This would make Masterpiece liable for the quality of work that Build them to fall produced for Grocery. The only exception to this rule would have been if the parties had entered into a novation which is a new, separate agreement by the promisee to release the original promissory from liability in exchange for a third partys agreement to assume the promisors duties. As for Masterpieces claim that they had a right to delegate the duties to Build them to Fall under commercial impracticability they would have to show that unforeseen conditions would have caused a delay or inability to make delivery of the goods (make performance impracticable), then they would have been able to claim commercial impracticability. In the absence of compelling circumstances, the courts do not readily excuse parties from their contractual obligations, particularly where it is clear that the parties anticipated a problem and sought to provide for it in the contract. Since Masterpiece had contracted to perform the work for Grocery and then had a sudden increase in jobs this would not be considered compelling circumstances for sub-contracting the job to a company that would perform a poor quality of work. C.) At the end of the summer, Jeff had earned enough money to put a down payment on a car. He decided to continue working part time during school to earn money for the car payments. Jeff purchased a car from Steve at the local used car lot. Steve did not ask Jeff how old he was; but assumed he had reached the age of majority. Jeff paid the down payment and signed the contract stating that he would make payments of $200 each month. Six months later Jeff lost his job and could no longer make the payments. Jeff took the car back to Steve and said he wanted to cancel the contract and that he wanted his money back. What are the possible outcomes? Explain your answers. Jeff was a minor at the time of the contract. Therefore, Jeff is considered not to have the capacity to enter into contracts. Steve made the deal in good faith that Jeff was old enough to enter into the contract.  Unfortunately, the contract is voidable. Jeff was correct that he could disaffirm the contract. And upon the disaffirmance, Jeff had to return the vehicle to Steve. Even though the right to disaffirm a contract was meant to protect minors, some states have rejected that idea because that view creates a hardship on the adult involved. Under the case of Dodson v. Shrader, 824 W.2d 545 Tenn. Sup. Ct. 1992), Steve would be allowed to recover the depreciation of the vehicle from the monies that Jeff has paid. Especially considering the fact that Jeff has had the vehicle for six months or more. The states defer on the idea that the minor needs to be reimburse the innocent adult for dealing with the minor. However, many times minors can pass as adults at approximately 14 years of age and up. Minors also get fake IDs to get things like buying beer. Therefore, by allowing the minor to get away with not paying the debt he or she willing entered or lied to the adult to sign a contract, is not in the best interest of society to allow the minor not to suffer the consequences. Therefore, holding the minor responsible for his or her actions is one way for the minor to learn responsibility. D.) Grocery has a written contract with Cereal, Inc. to purchase 20 cases of cereal per month at $22 per case. The contract does not state the types of cereal or how the 20 cases will be divided up between Grocerys 20 stores in Any State. After a flood, Cereal suffers severe water damage in its warehouse. With the exception of Soggy Flakes, Cereal does not have enough undamaged cereal to comply with its Grocery contract. On the day delivery was due, Grocery receives 10 cases of Soggy Flakes at the three stores located in My Town and two stores in Your Town. Promissory estoppel is an equitable doctrine that protects those who foreseeably and reasonably rely on the promises of others by enforcing such promises when enforcement is necessary to avoid injustice, even though one or more of the elements normally required for an enforceable agreement is absent (Mallor, et al, 2004, glossary). In this case an injustice to Harry did exist because of the money he spent in building onto his house and expectation he had of receiving the trains. Harry wins the case based on the recognition of promissory estoppels in section 90 in the first Restatement of Contracts in 1932 (Mallor, et al, 2004, 338). The court would see the injustice to Harry by Tom failing to fulfill his promise to sell his trains to Harry. F.) Jason shipped a truckload of peaches from his orchard to Grocery using an independent trucker. In route, the truck broke down and the shipment was delayed three days. The peaches were spoiled when they arrived. The terms of the contract were F.O.B. Who bears the risk? Explain your answer. F.O.B. (Free on Board) means the seller is responsible to deliver the goods  free of expense and at his own risk to the designated place of delivery. In this case Jacob was responsible for the shipment until it reached Grocery. Grocery would be able to file a suit against Jason for damages. Jason would, however, be able to file a suit against the independent trucker for the damages to the peaches. This case is similar to the case in the textbook Windows, Inc. v. Jordan Panel Systems Corp. In this case, however, the term FOB is not used. The windows were to be properly packed and shipped, but were damaged due to load shift during transport. The buyer, Jordan, expected to receive the windows in good condition, ready to install. When the windows were delivered in bad condition, Jordon filed against the trucking company and did not pay Windows for the order. Jordan then ordered a duplicate order to be shipped that Jordan received with no problem. The error in this case was that Jordan did not pay Windows for either order and Windows had to file suit against Jordan in order to be paid for the shipments. Judgment was affirmed in favor of Windows. G.) Discuss the different warranties that apply to Grocerys business. Explain your answer in detail. Grocerys business operates under the implied warranty of merchantability. This warranty is one that the legal community has created, not one that is operating under a written or accepted contract. The warranty operates under UCC section 2-314(l) . Section UCC 20314(l) reads: [A] warranty that the goods shall be merchantable is implied in a contract for their sale if the seller is a merchant with respect to goods of that kind. (Mallor, Barnes, Bowers and Langvardt, 2007). Under this warranty, Grocerys implied warranty is that the products sold will be useable for the purpose intended. Grocery would be held responsible for products like canned goods, meats, bakery items, and the like because Grocery is in the business of selling these goods. Section 2-314 states the products must meet the following criteria. (1)In the trade, the product must pass inspection without objection. (2)The product must be fit for the purpose for which the product wasintended;(3)The product must be of even kind, quantity (same size unit), and kind (like boxed cereal). (4)The product must be adequately packaged and labeled (must list things like the calories per serving). (5)The product must conform to the packaging and labeling regarding any promises or statements that may be stated (the cereal must be Rice Krispies and not Cheerios if the box is marked Rice Krispies). (6)If a product is perishable, the product must be of fair quality. If goods do not conform to the above standards, a consumer may pursue legal remedies. Furthermore, Grocery would be responsible for the goods sold at the store, not for computer products since the normal business of Grocery would be for canned goods, bakery items, meats, and the like. Grocery contended that the contract Bill Green signed was a standard preprinted supply contract without specifics regarding time of order and quantity. A Study Of Interest Group Lobbying Politics Essay The introduction of organized interests is nothing new in American politics. Political scientists, politicians, and scholars alike all agree that interest groups are natural phenomena in a democratic regime. Political interests have played a central role in American politics since James Madison first warned the framers of factionalism. Since then, the last five decades have seen an alarming rise of interest groups, changing fundamentally accounting the ongoing transformation of American politics and the pressures of campaign reform. Modern parties as well as established interest groups have demonstrated remarkable resilience and adaptability. The 20th century saw an increase in penetration of political and economic interests in the legislative, executive and judicial branches of government, leading to the growth of political activity that have opened doors while closing others. With these changes, interest groups have adjusted their strategy and tactics to adapt to the opportunities and constraints among the decision-making arenas. In line with these changes in American politics, it has revolutionized the representation and success of social movements. With the continuing need for more representation, politicians have come to recognize the impact groups can have when they mobilize support. Though they have impacted American politics in various ways, it is important to understand the methods they have used accounting the changing political environment. These strategies however, are not limited to one particular decision-making arena, but are the most commonly used. Interest groups are involved in American Politics in various ways. This especially is true within the judicial processes. When it comes to strategies used by interest groups, testifying before the Senate Judiciary Committee has become the most formal strategy pursued by interest group representatives. This process provides opportunity for interest groups to express their opinions directly to the people who have the power to accept or reject a nominee. While the former has been the most popular tactic for groups, it requires a high level of national prestige to acquire an invitation to this committee. In the case of Roberts and Alito nominations, the absence of interest group participation did not reflect their unwillingness to testify. Instead, their influence was mitigated by the committees refusal to allow interest group participation. While the former method has been one of the most effective ways to be represented, it requires prestigious interest groups which often require abund ant human and financial capital. Position taking on the other hand, is a low-cost alternative tactic used to support a judicial nominee. These actions serve to mobilize members and help generate contributions. Advertisements, on the other hand, have been the most common tool used in all decision-making arenas. As a result, interest groups have used television, radio, and billboards to support or oppose a judicial nominees. The growth in communication technologies has increased the number of strategic opportunities for interest groups. In fact, during the Bush administration, nearly all ads for or against Bush nominees were aired on cable new programs, which appealed to audiences who are more likely to be engaged in political affairs. Interests groups are also likely to also participate in mass mailings containing nominee information to fundraising support. More recently however, with the ongoing changes and development of technology, interest groups have begun using technology as a tool in electoral campaigns. Technological advancements have complemented traditional strategies. Websites, e-mails, and blogs, have become a cheap and effective approach over the last decade. When it comes to Interest group influence in elections such as the presidency, parties and candidates must have enough money to communicate and mobilize properly. Candidates seeking funds have found organized interests willing to contribute to those who share their political view. Interest groups involved in campaign contribution have seen the most constraints. Fortunately, federal campaign finance laws have been largely ineffective in limiting the role of special-interest money. Following the federal regulations after 1971, the Federal Elections Commission (FEC) has administered and enforced numerous federal campaign laws. By setting hard money contribution limits, it subsequently led to the rise of political action committees. Since hard money was defined as money contributed directly to a candidate of a political party (Loomis, 285), it was opportunity for interest groups to donate unregulated (soft) money to the political party as a whole. Subsequently, the Bipartisan Campaign Re form Act in 2002, prohibited unregulated contributions to national party committees. With the ongoing constraints by the FEC, PACs have become vey creative in allocating their resources. One strategy they have used is bundling, when PACs collect checks made out to a particular candidate and then send each candidate the checks all at once (Loomis, 191). Morgan Stanley, for example, bundled nearly $600,000 to the reelection campaign for Bush. In addition, PACs have also funneled money by giving contributions to other PACs or organizations that support their interests. 527 groups which refer to the groups that are not regulated by the FEC found various methods for advocating issues. As a right to free speech, groups were allowed to spent unlimited amount of independent money. They are able to do this by avoiding the use of specific words that include: vote for, elect, support, oppose. As special interest seek to influence government policy and members of Congress, two main strategies are commonly used; electoral and access. Most elected officials want to be reelected therefore they listen to people who can help or hinder that reelection. Interest groups take advantage of this situation by rallying voters to their cause and contributing money to reelection campaigns. Most interest groups cannot legally encourage their members to vote for or against a particular candidate, but they can achieve the same effect by informing their members of candidates stances on issues. For example, for years the Christian Coalition have issued voter pamphlets which describe the candidates positions on issues that are particularly important to group members, such as abortion. Other groups play the ratings game by publishing the positions of all members of Congress on key issues with the hope of swaying voters. Unfortunately, Electoral strategies are highly ambitious and risky which ca n often backfire in future elections. Access strategies however, are known as risk-averse strategies. These are techniques in which interest groups work to get access to directly influence an official. Unfortunately, given how busy members of Congress and other government officials often are, getting access pose major challenges. Sometimes a lobbyist can only get a few minutes of the officials time, so the lobbyist must be prepared to make a pitch very quickly. Some types of people have an easier time getting access than others. Some lobbying organizations use these types of people to help gain access. Actor Michael J. Fox, for example, has lobbied for increased funding for Parkinsons disease research. Both Angelina Jolie and Bono have also successfully lobbied Congress for their causes. When looking at social movements in the 21st century, one of the most successful has been the contemporary environmental movement. While interest groups have had more success in American decision-making institutions in the past, social movements have utilized similar tools to get their voices heard. Through coalitions with interest groups, private funding, technological advancements, the environmental movement has become a formidable force in American politics.

The Performance Of The Foxconn Business Commerce Essay Foxconn Technology Group, a subsidiary of the Hon Hai Precision Industries Ltd. and is one of the worlds largest electronics manufacturers. It ranks 112th among Global Fortune 500 Companies. Currently, Foxconn has a workforce of 900,000 workers all over China. The company plans to expand its workforce to 1.3 million people by the end of 2011 (Culpan, 2010). It manufactures hardware for a prominent list of clients, including Apple, HP, Dell, Nokia and Nintendo. Despite the fall of profit margins over past few years, Foxconns business has been growing. This implies that Foxconn will keep lowering labor costs to maintain its dominance in the industry. The recent uproar in media about Foxconn has not been because of its huge workforce or its profits. Rather, it is the 17 young Foxconn employees who committed suicides between January and August 2010 that has brought into light the dilemma of frontline employees at Foxconn and other such factories. The suicide rate for China stands at 12 for every 100,000 people per year. With a workforce of 420,000 and 13 suicides this year, the suicide rate at Foxconn is approximately one-quarter the national average (Mimi, 2009). This paper will elaborate on what the media have reported and relate the data to employment relations. Wages and Working Hours Foxconn claims that it is compliant with local laws. But, research studies conducted by SACOM (Students Scholars Against Corporate Misbehavior) have found that Foxconn has been a regular violator of labor laws. Many hidden facts relating to employment relations are discussed below. Workers were kept uninformed about wage increase plan When the suicide cases reached a climax in May, Foxconn apparently increased wages twice, but there was no formal announcement. Also, details about the conditions under which workers can benefit from this pay rise, like seniority or type of contract were not discussed. Basic wage is just slightly more than minimum wage and far below living wage The basic wage of frontline workers at Foxconn is only CNY 100 more than the minimum wage (SACOM, 2010). According to Foxconn management, the purpose of the wage increase plan was to stabilize the workforce. But the fact is that the basic wage was insufficient for workers to maintain decent living standards in Shenzhen. Also, basic wages in Tianjin, Wuhan and Kunshan lag far behind the standard wage, which makes it extremely difficult for workers to live in such expensive cities on such small incomes. Excessive overtime Marxism came into existence through Marxs observation a known writer and theorist who opposed capitalism while capitalism was in its infancy, his theory was named the Marxist theory. To Marx employment relation was a major way of understanding capitalism. He was like an opposition force for the employers, he disputed the divisions that were created in the industrial society through competition between the two classes (employers and the employees). He was of the idea that since employees had to do meaningless jobs it created low esteem, morale and low motivation amongst the employees. His approach created the thought that conflict will persist in the employment relations and no solution will be able to resolve it completely, and the only basic changes in the economy, such as overthrowing capitalism, will help in creating a socialist economy, however, China is already a socialist economy and state. One could argue that because China is a communist state, it operates on socialist values and employs Marxist philosophies in order to improve the wellbeing of the Chinese people. However, from the Foxconn example, we can see that this was not the case and this raises the question of if the Marxist theory really has any relevance in improving self esteem, when Foxconn has violated several Labor Laws . In any working environment, overtime work should not be more than 36 hours per month (article 41) (SACOM, 2010). For example, engineers at Integrated Digital Product Business Group (IDPBG) of Foxconn in Shenzhen, who were involved in production of the first generation iPad, worked whole weeks, including Sundays and had only one rest day every 13 days plus they did not even receive any overtime premium for weekends. There are other departments where workers work overtime for about 140 hours a month and have no day off at all. Deduction of overtime premium According to workers at Foxconn, calculation of working hours is incorrect. Foxconn uses Comprehensive Calculation of Working Hours System, which does not recognize monthly overtime beyond 80 hours (quote) and hence, workers are not paid for those hours.  Also, workers complained that the newly introduced overtime control is actually misleading in the sense that overtime does take place, but it is not recorded or paid as such. Apart from all this Foxconn employees are made to attend morning assemblies, end-of-work-shift assemblies and weekly meetings during which the management talks about expected deliverables, work targets and discipline, but they do not receive compensation for the time spent in these compulsory meetings that may consume up to one hour a day. Time spent in training is not fully paid either. As a result, workers do not earn more than before the June 2010 wage increase. Management A close analysis of the management practices and workers criticisms about the management at Foxconn is indicative of the fact that a military-style, punishment focused working management followed at the company for its workers is another factor that might have contributed to suicides at Foxconn. A culture of obedience is forced on workers from the first day of their employment. They are badly treated during recruitment procedures; they are not allowed to questions during their orientation trainings; they are punished for all kinds of misconduct, ranging from as big as not meeting their daily deliverables to as minute as taking too much time in bathroom. Reward system Workers are deprived of production bonus, which is given twice a year, if they have declined overtime work or taken sick leave. It seems that there are no set terms for a bonus; it is exclusively at the discretion of the management. All these factors reflect the authoritative nature of Foxconns management. Foxconns military-style corporate philosophy is also reflected in one of the sayings of Foxconns billionaire CEO Terry Guo democracy is the most inefficient thing in the world (Chang, 2010). This explains why Foxconn regime excludes any say by workers and why it is so anti-democratic. Trade Unions Theories kept evolving as the size and scope of businesses expanded, taking into consideration technology and the nature of work of the employees. One of the theories that came about was the pluralist theory, which acknowledged the complex situations such as conflict of interest between the management and the employees. It suggested that these kinds of complex situations could only be resolved through the involvement of government. However, because China is a communist state, trade unions struggle to exist and therefore pluralism cannot and wont be adopted. Investigations at Foxconn reveal that workers have no confidence that the state-run trade unions will defend their rights for very obvious reasons. First, these unions are usually silent on working conditions of the company. Instead, at the companys morale-boosting rallies, the union officials glorify Guos image and Foxconns corporate image by displaying portraits of Guo and singing his praises. Second, these trade unions consist of few young members and majorly of senior management officers. Apparently, the union members tend to please the management in order to secure their jobs. Last, the trade union committee is not democratically elected. This is indicative of the political power exercised by Foxconn and its higher management. Health and Safety Most of the workers are not aware of the damaging effects of chemicals they use and of the precautionary measures they must follow before working with dangerous materials on the factory floor. Many of them suffer from threat of occupational diseases. Under the increased pressure, 12.7 percent of workers experienced fainting spells, 24.1 percent of female workers had irregularities in their menstrual cycle and 47.9 percent of workers complained of mental stress. This clearly shows the lack of training for workers on occupational health and safety. Moreover, denying protective equipments and health examinations to workers shows managements informed negligence in following safety standards for workers. Relocation Plans Currently, Foxconn has a huge workforce of around 420,000 in Shenzhen plant alone. In the result of series of suicides, Foxconn announced its plan of relocating its production to central, western, and northern China, where labor is plentiful and official minimum wages are lower than in other areas. Workers were again uninformed of the details but anyway, they had no choice but either relocate or resign. A serious implication of this move is that the announced wage increase for the Longhua workers in Shenzhen will become irrelevant. Social Factors Though Foxconn offers accommodation for workers, but it is more like a prison to them. As a result of their low pay, most workers are forced to live in crowded factory halls. On average, each worker has a space of about two square metres. There is no social interaction among roommates because of their different backgrounds and shift timings. Social isolation in Foxconn is regarded as one of the chief causes of the suicides. A prison-like safety mesh is installed in every hall building in many facilities to prevent workers from jumping. This indicates that management is aware of the potential intentions of the workers. All the factors discussed above help us realize the physical, social and psychological agony workers at Foxconn go through each day. These factors highlight the underlying causes of the dilemma of workers at Foxconn and at other such companies. Illegal and unethical labor practices followed by Foxconn, lack of basic democratic rights for workers, monopolistic capitalist mode of production by translational corporations in global supply chains, lack of auditing by the government of the employment terms and practices followed by companies, discriminatory characteristic of Chinas urban household system, lack of government support are some of them. Conclusion The essence of all these traditional theories of management styles is that there exists a single, best approach to management, and the research was aimed at finding this best approach. One of the recognized theorists was Fredrick W. Taylor. His purpose and idea was to maximise efficiency, he believed that the principal object of management should be to ensure maximum prosperity for the employer, coupled with the maximum prosperity for each employee. He considered that the best approach was for the employee to fulfil optimum goals, which would result in higher wages for them, and managements gain will be higher productivity. Therefore the employee himself will work harder and try his level best to produce more since he is getting financial benefits for doing so, this was his differential piece-rate system. This clearly was not the case with Foxconn, as demonstrated by the evidence highlighted throughout the body of the paper. In the past few years, manufacturing facilities or so called sweatshops have started following labor laws but at the same time to make up for the loss, they have developed strategies to speed up the production in factories. As a result, production targets keep soaring and labor exploitation does not stop. Thus far Foxconn and its high-profile customers including Apple, HP, and Dell have failed to effectively address underlying labor issues at the Foxconn production facilities. But, Foxconn is not the only one to be responsible; these other big electronic brands, which place orders with Foxconn, are equally responsible for the tragedies. By threatening to shift their orders, they force their suppliers in China to lower wages, prolong working hours and intensify workloads and thus directly pressure the workers. Clearly, all these brands are making huge profit at the cost of the workers miserable lives. It is apparent that the grievances of the workers cannot be addressed by Chinese labor laws alone. It is required to reveal the actual working and living conditions of workers at Foxconn to gather public support for their struggle against their plight. Pleading companies to abstain themselves from violating labor laws is futile; instead, people must urge concerned organizations, consumers, investors, and the government to join the workers to pressure electronic factories to improve working conditions and employment relations in the electronics industry. Also, to fight for workers rights, effective trade unions must be formed by holding democratic elections in accordance with the Trade Union Law in China. Foxconn needs to reform its structure. There is a need to meet the political requirements, which calls for better wages, recognition of workers rights and the development of hi-tech industries that will create better living standards for workers. Foxconn must address communication gap between management and the labor and focus on employee satisfaction, rather than solely company profits. Workers must be kept informed about their rights, about the relocation plans well in advance, about any wage increase plans and be provided with the details of the terms and conditions followed for giving bonuses. These are just basics principles of employment relations, which Foxconn have not come close to meeting.

How Needs Friends? As the plane taxied to the runway, I found myself sitting alone with two empty seats next to me. Oh, joy. I fluffed my pillow, retrieved my book, and stretched myself out under a blanket. All was good. If I had had any idea that the seating arrangement was to be the highlight of my trip, I might have just stayed on the airplane. In making plans for this trip, I forgot that life seldom works out according to nice and tidy plans. Life is, in fact, usually messy. The best vacations aren't always the ones really taken but are instead sometimes the ones you take only in your imagination. Judy, Lois and I met when each of our lives was in upheaval. Between us, two marriages ended in divorce, one parent died, one daughter moved across the country, one car was repossessed, one house burned down (it wasn't my fault), and one I.R.S. audit was threatening. Together we had been, if not to hell, at least to purgatory and back. Our friendship seemed solid and assured; even when after remarrying, Lois decided to move to North Carolina to be near her family, especially her daughter. This daughter, this wicked girl, waited until the U-haul pulled up, car in tow, to announce that in six months she was getting married and moving to Texas. For Judy and me, it meant a trip, an engagement not to be missed. The three of us together again was going to be grand. I could hardly wait. I imagined I'd hop on the red-eye and be in Asheville for breakfast. A reunion of unprecedented glee would ensue. After that, we would check out the wedding site, see the monuments to the city's Civil War soldiers, and check out the local watering hole. Later, there would be the meeting with the family and the fulfillment of other pleasantries. Then we would talk into the night, sipping bourbon and tittering quietly so as not to wake the household. The wedding was scheduled for Saturday morning, and I thought it could be potentially awkward for Lois. You see, Lois' first husband, Hank, the father of the bride, would be there. Lois' second husband, Henry, the man she left Hank for, would be there. Lois' third husband, Steven, the man she left Henry for, would be there, too. The only task Judy and I would have was keeping the three husbands at equal distance from each other.

Almost 18 years ago an innocent wife and mother to two, named Sarah Bryne, received a call by her husband’s old college roommate. He explained to her that he and his wife were staying at a secluded motel near her work and were only staying for the weekend. She left work early to go and meet him and his wife. When she arrived he was alone. Once she was inside and the door closed he raped her. After raping her he stuffed her inside a small trunk, put the trunk in the back seat of his car and drove away. She made a help me sign in red lipstick and slid it through the trunk. Many motorists saw this plea and called the police. But before they could catch up he stopped on a secluded farm road, ripped her out of the trunk, strangled her with a necktie, broke her neck, and then finally finished the torture by stabbing her 14 times. He then put her mangled body back in the trunk and drove home to his wife and kids (1). There is only one offence in the state of Washington that you can receive the death penalty for and that is aggravated murder in the first degree. To receive this punishment one must plan out his act and in committing the crime commit an aggravating circumstance (3). Stabbing + raping + breaking a neck + strangulation all add up to an aggravated circumstance. It’s for people like this that we have instituted the death penalty. The death penalty is a just punishment, but like any system it does have some flaws. Although the death penalty does not work too well as a general deterrent it does work as a specific deterrent. Specific deterrent means that the penalty is keeping the offender from re-offending (2). Studies show that those who commit murder, if given the chance, re-offend. But some may wonder, isn’t life in prison keeping them from committing the crime again? The Criminal Justice Legal Foundation states that â€Å"the leading cause of death among prison inmates is murder by other inmates. A murderer serving a life sentence has no reason at all to refrain from killing other inmates or guards, or from hiring other criminals outside of prison to kill those who helped convict them.† But on the other hand the death penalty offers the opposite effect when it comes to general deterrence.

The Importance of Economics in the American Revolution :: American War of Independence

The American Revolution is the most important event in the New World history. It was the process where the thirteen colonies of North America became independent of Great Britain and then formed a new unified government. The Americans fought against the British for a number of reasons, but the most important reason was economic in nature. The American Revolution was fought for different ideas that were important in those times. The economy in America was not the best, and people had to support all the orders from Great Britain because this was their home country. Therefore, the British controlled the economy of North America. Many Americans thought that the British were making injustices with the American economy and this was the main reason for the revolution. The American Revolution had their principle figures in the liberal people, who thought that Great Britain was doing injustices within the colonies. One of the liberal people main points was "never believed that everyone should be equal economically" (McKay, 692). The difference between rich and poor in respect to income and wealth was not a problem for the liberals. The main point was that everyone should receive an equal opportunity to produce wealth and income. The most important figure of these liberal people was Thomas Jefferson, who wrote that everyone should be treated equal in owning property. The economy was controlled and affected by the decisions the government of Great Britain took. The economic part that most felt these injustices was the maritime workers, who were controlled by the Royal Navy. According to Richard B. Morris in his book The Emerging Nations and the American Revolution: "off all working-class groups, the seamen felt perhaps the most oppressed and exploited. Rootless, they had the least stake in the status quo. . . they proved the hard core of the ‘muscular radicals’ so cleverly manipulated by affluent merchants and shrewd lawyers" (Morris 4-5). Along with the seamen, the mechanics also suffered these injustices. Mechanics had a common economic resentment against the new tea measures of the British government and a common desire to have a larger voice in domestic politics. Between 1740 and 1783 the economy of colonial America and the United States was usually threatened, engulfed in or recovering from war. Many businesses were controlle d by merchants and monopolistic people who exploited the colonies.

Medieval and Renaissance Art Essay

The most significant difference between medieval and renaissance art is that renaissance art paid more attention to the human body, and to detail. Both, however, focused mainly on religious themes, although not necessarily Christian. Renaissance artists are remembered because they brought about the changes that led to the art of today. When looking at medieval art, such as â€Å"The Notary of Perugia Writing a Document† it is quite obvious that very little attention to detail is included. There is no depth to the painting, the writing on the parchment bares no resemblance to actual text, and everyone in the picture has the same face. In contrast, when looking at a renaissance painting, like Christ the Redeemer by Titian quite a bit more attention is given to detail, even though the scene does not encompass nearly as much. It is possible to see shadowing in the painting, as well as to the behavior of fabrics. There is also a good feel of depth with much attention paid not only to making a nice background, but separating it from the foreground as well. There are many similarities in the two styles; they are, after all, separated by a short period in history. One similarity might be a choice of colors, as the most visually appealing color combinations had yet to be discovered. Another similarity would be the lack of understanding of how to accurately represent the human body, as this was considered sinful by the church; Leonardo di Vinci did began to change this with some of his works though. The short period in time left similarities between the styles of art, but they were few, far between, and diminished fast. Renaissance artists put forth much greater effort into these works and it really shows in the quality, rather then the quantity produced.

Edgar Allan Poe and Momentary Satisfaction Revenge

Revenge; Justified or Momentary Satisfaction Revenge is such a common thread in today’s society. It is evident in television, movies, literature, politics, and even among friends at school. Everyone wants revenge. Revenge is a common tendency of human nature, but revenge is never justified. Many people live their lives with the philosophy of â€Å"an eye for an eye†, but as Mahatma Gandhi said â€Å"An eye for an eye only ends up making the whole world blind. † When you think of all the little things people do to â€Å"get back† at those who hurt them in some way, you begin to see a pattern of destruction, even if it is on a small scale.The point here is that revenge very rarely serves its true purpose, which is a sense of self-satisfaction. Seeking revenge ends up making you look like the bad guy and usually backfires. Humans have an urge to get even with one another for what the other has done. Often time’s karma is a better judge of people than t hemselves. The quote from Robert F. Kennedy that states â€Å"Don’t get mad, get even. † is wrong; as revenge is just a case of self- satisfaction. In â€Å"The Cask of Amontillado† by Edgar Allen Poe, in paragraph 29 it states â€Å"Once more let me implore you to return.No? Then I must positively leave you. But I must first render you all the little attentions in my power. † Montresor is mocking Fortunato and then leaves him, he then states (last paragraph) â€Å"My heart grew sick- on account of the dampness of the catacombs. † I believe that he is saying he regrets doing what he did, and that revenge only satisfies ones need for a moment. Revenge is short lived, and has no long term use in this life. It is simply a temptation beating on our door of reality.No matter what level of hurt one does to another; killing a loved one or simply stealing your pencil at school, it is never justified to do something back. In â€Å"A Poison Tree† by W illiam Blake, someone does another wrong; He tries to get even by poisoning him. â€Å"I was angry with my friend, I told my wrath, my wrath did end, I was angry with my foe: I told it not, my wrath did grow. † His foe makes him angry so, to get back at him he poisons him with an apple. â€Å"And into my garden stole, when the night had veiled the pole; in the morning glad I see my foe outstretched beneath the tree. He got even with him by killing him; this is taking it to the extremes. There is always another way; â€Å"She got even in a way that was almost cruel. She forgave them. † – From Ralph McGill (about Eleanor Roosevelt). This is saying that instead of revenge do the opposite, forgive. Maybe they want one to do something back to them, but don’t give them the satisfaction of seeing one’s self try to get even. They are not worth it. Forgiveness is not revenge but the willingness of one’s self to move forward with their lives, and not live in the past of what has been done to them.Two wrongs don’t make a right. When someone does another wrong and one’s self does something wrong back it will never make one fully happy. In the Mentalist when Red John kills Patrick Jane’s wife and kid, he joins the C. B. I. team to one day seek revenge on Red John. When he finally captures him, he says he doesn’t feel much better. Revenge is never justified, no matter what. It is a human’s self- satisfaction that drives them to get back but, in the end no one wins; everyone suffers.

High School and Advance Placement Classes

Ever since I can remember, my ambitions were to make this world a better place by solving crimes and putting criminals behind bars. I am truly motivated to contribute to this patriotic country. I will risk my life for it if that is what it takes. My commitment, dedication and effort in my academic and extra-curricular activities will help guide me into my lifetime goals of becoming a criminal psychology, and getting a degree combined with law and psychology. High schools provide students with the chance to prepare for the real world and I refuse not to take advantage of it. For example, the activities that are fostering me into my future are extra-activities and core courses.Drill team has given me the power to adequately deal with the demands and challenges of daily life. All that was expected of me I excelled in. Being a member has helped me flourish into a mature individual. Throughout all of the experiences on drill team, I have developed leadership and social skills that are ben eficial in majoring in criminal justice. My director pushed me to the limit to help me grow in the same way they would in criminal justice. In any career they want to excel in.I was able to stay committed and not give up during all those stressful times. Therefore, proving I am ready for what college has in stores for me no matter how hard it gets. In dance, it has helped me become fit from having to dance year round. In most careers in criminal justice it is required that you pass timed test for physical activities. In dance I discovered how passionate I feel about working out.Taking psychology and sociology, will aid me in my lifetime goals because those classes are required in my career path. In completing these courses during high school, it will be a big advantage in helping me to comprehend them in college. I will have prior knowledge. When taking that class in college, I will be prepared for it and I also could take my notes from high school to refer to. It helps me with crim inal profiling and provides strategies and suggestions that can be used in the interviewing process of finding the killer or kidnapper.I have been taking Pre-Advance placement and Advance Placement classes since freshman year. Taking advanced placement classes by far has really helped me  get a better understanding of what to expect from college courses. My teachers act like professors therefore I know that professors will treat me like an adult. My instructors teach the way university instructors would and I am still able to obtain exceptional grades in my classes. Advance placement classes boosted my grade point average therefore it will help me get into a wonderful college of my choice.In high school, I am dedicated towards my long time goals. I want to say I was someone in life. I have learned how to balance a job, extra-curricular activities, and my academic performance. These skills will guide me tremendously in my long term goals. My ambitions are to keep this world a safer place. Even if it means not having fun and focusing on my future I am driven enough to do it. If I want to be successful and get a good education and career I must have determination, encouragement, and fulfillment. Success is finding your way to reach your goals in life.It is a journey which has several peaks that build on one another. It comes from within while realizing what my own strengths and weaknesses are to determine my accomplishments. In high school I am given this opportunity that will help me with any barrier in life. Patient billing System is very important. These are collections of information’s about a patient’s health history. Doctors and the others personnel of the hospital like nurses write is medical records so that they can used the information’s again when the patient’s come back to the hospital. It is job of patient’s registry records works to make sure that the information is intact and available anytime when the patient returns to the hospital. Many hospitals in India still manage the patient data manually. Hospitals will be able to save money and time if they have a good software program for  managing patient’s data. The idea is to develop web based patient billing software that can be used to keep track of the patients registering in a hospital or clinic. Doctors and the rooms available in a hospital can be managed using this system. Also, this system should support accessing the previous visit histories of any patient, search for patients by name etc. * A patient can be categorized as â€Å"In patient† or â€Å"Out Patient†. If patient type is â€Å"In Patient†, a bed will be assigned to the patient. * A doctor will be assigned to each patient before the patient meets the doctor. Only one doctor can be assigned to a patient at a given time. * A patient can visit the hospital any number of times Administrator will have complete control of the system. She/he can Add/Edit/Delete patients, Add/Edit/Delete Doctors, Add/Edit/Delete Beds, Search for patients, Assign patients to doctors. Doctor can access a patient’s record and update his observations about the patient in that particular visit. ABOUT BILLING: Hospital bill for inpatient will include a room charge, which covers room, meals, nursing care, housekeeping, maintenance, medical records and admitting services. Bill will also include itemized charges for specific ancillary services such as laboratory, medications, X-rays and use of the operating room, surgical day care, recovery room, physical therapy and other services. Hospital bill for outpatient will include consultation charges and also include itemized charges. Bill will not include visits by physician and fees for radiology (interpretation of X-rays), anesthesiology, emergency medicine, surgery, and other professional services and consultations provided by physicians. These will be billed separately by the physician. EXISTING SYSTEM: The existing system of the patient billing is completely manual. The secretary or the receptionist will write patient information into a medical  form. The clinician takes the medical history of the patient, writes diagnosis and treatment on the form. The Clinician sometimes can refer the patient to the laboratory for medical test before diagnosis depending on the situation of the patient. All the patient form are collected and kept in the filling cabinet for follow up check and future use Disadvantages of Existing system: * The existing system needs to save patients information in the form of excel sheets. * The manual system gives us very less security for saving data. * Some data may be lost due to mismanagement. * Searching of particular room vacancy information is very critical where it takes lot of time. * This system is not having the facility of tracking transfers of patients from the general ward to the ICU and vice versa. * Cannot Upload and Download the latest updates. * No use of Web Services and Remoting. * The existing system is Less user friendly Proposed system: The modern computerized system is developed with the aim to overcome the drawbacks of existing system. The proposed system has got many advantages. It will improve the keeping of medical records of the patient, can handle data efficiently, more accurate in filling and retrieving of records.
